This Privacy Policy explains how we collect, use and disclose information received from users of the Dealerdirect website and its associated services (collectively, the "Website"). “We” “us” and “our” refer to Dealerdirect USA, a California corporation. “You” and “your” refer to each user of the Website and, as applicable, any individual or entity on behalf of which such individual uses the Website. Capitalized terms that are not defined in this Privacy Policy are defined in the Terms of Service [link].

We may revise this Privacy Policy from time to time. If any revision is material, we will notify you via a post on the Website or e-mail to the address associated with your account.

1. Information Collected

The Website collects personally identifiable information you knowingly disclose and information from your interaction with the Website.

To register at the Website, you must provide us with your name, email address and a password chosen by you. Once you are registered, you will be required to provide additional information, such as your physical address and telephone number. When you contact us by email, we may store your contact information and correspondence, and may use your email address, and any information you provide, to respond to you.

To carry out the purpose of the Website, we collect Providers’ information about their Cars and Dealers’ Bid information.

The Website uses cookies to make your use of the Website easier, to track use of the Website, and for advertising purposes. For these purposes, we may collect any of the following information: IP address, session number and customer number. Using your browser settings, you can remove or block cookies, or request to be notified if you receive a cookie; however, blocking cookies may affect your ability to use the Website.

2. Uses of Information We will use information that you provide to administer your account, to communicate with you and to facilitate the purchase and sale of Cars. As described in the Terms of Service [link], to carry out the purpose of the Website, we share Providers’ information about their Cars with Dealers; winning Dealers’ Bids with the applicable Providers; and Sellers’ and Buyers’ information with one another once a Bid has been accepted.

We may communicate with you via e-mail, the Website and by telephone, and all telephone calls will be recorded; however, we will provide an opportunity for you to opt out of communication by telephone. You are responsible for any service charges from your service provider for any such communications.

We may disclose certain information that you provide with carefully-selected unaffiliated companies. However, we will provide an opportunity for you to opt out of such disclosure.

In addition, we reserve the right to use, read, preserve and disclose any user-provided information as we reasonably believe is necessary to (a) satisfy any applicable law, regulation, legal process, subpoena or governmental request, (b) enforce these Terms, including investigation of potential violations of them, (c) detect, prevent or otherwise address suspected fraud or security or technical issues, (d) respond to user support requests or (e) protect the rights, property or safety of the Website, its users or the public.

When you close your Website account, information that you have provided will no longer be available to other users via the Website. However, we reserve the right to retain all information that you have provided, to use such information for internal business purposes, and to disclose that information as set forth in the preceding paragraph.

3. Security

Access to information that you provide to the Website is password-protected. While we use industry-standard security measures to protect that information, no security measures are perfect. Furthermore, we cannot control the actions of others who may receive your information. We are not responsible for circumvention of any security measures or privacy settings contained on the Website. If we learn of a security breach, we will notify you if and as required by applicable law.
